Why Extensions are Processed Favorably:

Extensions are treated more favorably than new cap-subject filings due to two main factors:
  •  Cap Exemption: H-2B extensions for current employees are generally exempt from the annual cap. This means the government does not have to deny       them due to a lack of available visa numbers, which is the main cause of rejection for initial petition.
  •  Established Continuous: The employer has a proven history in the program. The DOL certified the job in a prior year, and USCIS approved the      worker's status, demonstrating the employer has already met the core requirements of proving a temporary need and complying with all wage and recruitment rules in the past.

While the approval rate is high, an extension can still be denied if:
  •  The employer fails to conduct the new mandatory recruitment (SWA, newspaper ads, etc.) correctly for the next season.
  • The employer fails to demonstrate a continuing temporary need for the job.

These fees are based on the USCIS fee rule that became effective on April 1, 2024, and are subject to change by the government.

Here is a detailed breakdown of the required fees paid to U.S. Citizenship and Immigration Services (USCIS) by the petitioning employer:

 

1. Form I-129, Petition for a Nonimmigrant Worker (Extension Fee)

The base filing fee for the extension is determined by the size and type of the petitioning employer and whether the H-2B workers are named or unnamed. For an extension for workers already with the employer, the workers are typically named beneficiaries.
